Lee Taft successfully mediated two of my sexual assault cases in 2012. To call his method mediation, however, profoundly understates the significance of the process.

In both cases, legal disputes in the nature of assault claims were being presented to him, but, in truth, the reason the parties were calling upon Lee is that they had a moral and emotional rupture between themselves as a result of the assaults which needed to be reconciled before either party could go on with their lives. Lee’s method, including pre-mediation meetings to explain the restorative process, led to sincere, and spiritually significant, statements of repentance and apology by the perpetrators of the assault to the victims, catharsis for the victims, and at least the beginning of forgiveness for both.

The first of the two mediations was an introduction to a very interesting approach to dispute resolution; the second was one of the most stirring experiences of my 33-year legal career.

As a plaintiff’s litigator for twenty years, I saw first-hand how litigation –and litigators – failed both parties. I began to explore alternatives to litigation. That exploration led me to Harvard Divinity School where I wrote my graduate thesis on the role of apology and forgiveness in mediation.
